Privacy Policy

HERS ECC TITLE 24 GROUP respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when providing HERS, ECC, Title 24 inspection, testing, reporting, and related services.

INFORMATION WE COLLECT

Payments made by credit or debit card are processed through Square or another authorized payment processor. HERS ECC TITLE 24 GROUP generally does not receive or store complete payment-card numbers. Payment processors handle payment information according to their own privacy and security policies.

COMMUNICATIONS AND OPT-OUT REQUESTS

If you provide your telephone number or email address, you authorize us to contact you regarding appointments, inspections, payments, reports, project requirements, and customer-service matters.

Consent to receive text messages is not a condition of purchasing services. Message and data rates may apply. We do not sell or provide text-message consent information to third parties for their independent marketing purposes.

To opt out of nonessential or promotional communications, email info@hersecctitle24group.com with “OPT OUT” in the subject line.

Opting out will not prevent necessary transactional or project-related communications concerning active appointments, inspections, invoices, compliance reports, registry requirements, or services you requested.

FIELD PHOTOGRAPHS AND PROJECT DOCUMENTATION

Inspectors may take photographs or videos of equipment, installations, labels, property conditions, test setups, and inspection results. This documentation may be included in project records, reports, registry submissions, quality-assurance reviews, correction notices, or communications with authorized project participants.

We do not use interior project photographs for public advertising without permission, unless the information has been appropriately anonymized or its use is otherwise permitted by law.

DATA RETENTION

We retain information for as long as reasonably necessary to complete services, maintain business and compliance records, respond to disputes, satisfy registry requirements, support audits, and comply with legal, tax, insurance, and regulatory obligations.

Some reports and registry records may need to be retained for extended periods and may not be eligible for deletion.

DATA SECURITY

We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no electronic transmission, payment platform, registry, email system, or storage method can be guaranteed to be completely secure.

CALIFORNIA PRIVACY RIGHTS

California residents may have the right, subject to applicable law, to request:

These rights may be limited when information must be retained for compliance documentation, registry requirements, legal obligations, completed transactions, security, fraud prevention, disputes, or other lawful business purposes.

We may need to verify your identity and relationship to the project before completing a request.

THIRD-PARTY SERVICES

Our services may involve Square, CHEERS, government agencies, compliance registries, and other third-party platforms. Those organizations maintain their own privacy policies and security practices. HERS ECC TITLE 24 GROUP is not responsible for the independent privacy practices of third parties.

CHILDREN’S PRIVACY

Our services are intended for property owners, contractors, builders, and other adult project participants. We do not knowingly collect personal information directly from children under 13.

POLICY UPDATES

We may update this Privacy Policy when our services, business practices, legal obligations, or technology change. The updated policy will apply from the effective date shown in the revised version.

INSPECTION PAYMENT & INVOICE POLICY

PAYMENT METHODS

Credit and debit card payments are accepted through our invoicing system and are subject to a 3% processing fee, which will be added to the invoice total.

At this time, we do not accept checks.

PAYMENT DUE DATE AND LATE FEES

Payment is due upon receipt of the invoice unless different terms are provided in writing.

A 3% late fee may be applied to any outstanding balance not paid within seven calendar days of the invoice date, to the extent permitted by law. Additional collection costs may apply if an unpaid balance requires collection action.

Our invoicing system automatically sends daily reminders until the balance is recorded as paid. These reminders are system-generated and are not personal.

PROCESSING TIME AND COMPLIANCE DOCUMENTATION

Reports and compliance paperwork are generally prepared within 7–10 business days after payment and receipt of all required project files, documents, signatures, and registry access.

Processing time begins on the later of:

Delays caused by missing information, corrections, registry issues, contractor actions, equipment problems, or required retesting are not included in the estimated processing time.

For San Francisco projects, a compliance letter may be issued on the same or next business day following payment and completion of the inspection. When available, a temporary letter may be provided while the final registered report is being processed. Please contact our office if one is required.

INSPECTION RESULTS AND RESPONSIBILITY

Payment covers the inspection, testing, reporting, administrative work, and registry processing described in the invoice. Payment does not guarantee that the project or installed equipment will pass inspection.

Responsibility for installation quality, code compliance, equipment performance, corrections, and passing inspection remains with the contractor, homeowner, builder, installer, or other responsible party.

Unless specifically included in writing, return visits, retesting, corrections, permit assistance, additional forms, expedited processing, and work outside the original scope may require an additional fee.

CANCELLATIONS AND REFUNDS

Payments are final and nonrefundable once an inspection has been performed, an appointment has been reserved within the applicable cancellation period, project registration has begun, or administrative or reporting work has started.

Registry fees, processing fees, completed inspections, testing, travel, and administrative services are nonrefundable.

CHEERS ACCOUNT AND REGISTRATION REQUIREMENTS

The project’s responsible party must maintain the appropriate CHEERS account, subscription, role assignment, and registry access required for the project.

The Non-Rater project registration fee generally applies to projects registered for permit and documentation purposes that do not require a HERS or ECC Rater inspection.

All CHEERS subscriptions, project registration charges, and other registry fees are paid directly to CHEERS and are not included in this invoice unless specifically stated otherwise.

CHEERS controls its own pricing, subscription terms, prorating, billing periods, and registry requirements. These items may change without notice.

DISPUTES AND CHARGEBACKS

Please contact our office directly regarding any billing concern before filing a payment dispute.

By submitting payment, the customer acknowledges and accepts the scope of services and the payment, cancellation, refund, and dispute terms stated in this policy.

A chargeback involving a legitimate and authorized payment may be treated as a breach of these terms. Unpaid balances may be referred for collection or pursued through small claims court, including legally recoverable filing fees, administrative expenses, collection costs, and related expenses.

HERS ECC TITLE 24 GROUP reserves the right to suspend pending reports, documentation, registry processing, and future services while an invoice remains unpaid or is under dispute, where permitted by law and applicable registry rules.
